These Terms & Conditions ("Terms") govern your use of ClearPath Credit's services, including credit consulting, report audits, dispute letter preparation, and related educational resources (collectively, the "Services"). ClearPath Credit is a credit services organization ("CSO") as defined under New Hampshire Revised Statutes Annotated ("RSA") Chapter 359-D (the "Credit Services Regulation Act"), the federal Credit Repair Organizations Act ("CROA") (15 U.S.C. §§ 1679 et seq.), and the Fair Credit Reporting Act ("FCRA") (15 U.S.C. §§ 1681 et seq.). We comply with all applicable federal and state laws, including RSA 358-A (Regulation of Business Practices for Consumer Protection) and RSA 399-D (Debt Adjustment).

By accessing our website, submitting a form, or purchasing Services, you agree to these Terms. If you do not agree, do not use our Services. These Terms form a binding contract between you ("Buyer," "Client," or "you") and ClearPath Credit, LLC ("we," "us," or "our"), a New Hampshire limited liability company located at [Insert Address, e.g., 123 Main St, Concord, NH 03301].

1. Services Provided

ClearPath Credit offers non-legal credit consulting and educational services to help you review and dispute inaccuracies on your credit reports. Our Services include:

-Credit report audits (analysis of Equifax, Experian, and TransUnion reports).

-Preparation of FCRA-compliant dispute letters for inaccurate or unverifiable items (e.g., late payments, collections, inquiries).

-Debt validation and cease-and-desist letter templates.

-Credit rebuilding guidance, score tracking, and monthly progress reports.

-Business credit profile assistance (Elite Plan only).

-Legal referral introductions (Elite Plan only; we do not provide legal services).
We are not a law firm, attorney, or debt settlement company. We do not provide legal advice, represent you in disputes, negotiate debts, or guarantee outcomes. You must review, sign, and mail all letters yourself. Services are educational only and align with practices of other CSOs like Credit Saint, Lexington Law, and The Credit Pros, which also prepare templates without legal representation.

2. Prohibited Practices and Compliance

In accordance with RSA 359-D:3 and CROA, ClearPath Credit shall not:

-Charge or receive payment before fully performing Services (except as permitted under our surety bond; see Section 9).

-Make false or misleading claims about Services (e.g., no guarantees of score improvement).

-Charge for referrals to lenders on terms not substantially better than public offers.

-Fail to provide required disclosures (see Section 4).

We adhere to RSA 358-A's prohibition on unfair or deceptive acts in consumer transactions. Violations may result in remedies under RSA 359-D:11 (actual damages, attorney's fees, and up to $5,000 in punitive damages).

3. Eligibility and Client Responsibilities

-You must be 18+ and a U.S. resident. Services are for personal or business credit only.

-You agree to provide accurate information and authorize us to access your credit reports for auditing (soft inquiry only; no hard pull).

-You are responsible for: Reviewing/signing all letters; mailing via certified mail; responding to creditor inquiries; and maintaining compliance with FCRA/CROA.

-We reserve the right to terminate Services if you misuse them (e.g., disputing verifiable items).

4. Required Disclosures (Per RSA 359-D:4 and CROA)

Prior to any contract or payment, you receive this written statement:

INFORMATION STATEMENT
ClearPath Credit is registered as a CSO under RSA Chapter 359-D. Our principal business address is 69 Eastern Avenue, Manchester NH 03104. We are bonded under a $10,000 surety bond (minimum $5,000, maximum $25,000 per RSA 359-D:8) issued by [Insert Surety Company, e.g., XYZ Surety Co., Policy #12345], filed with the New Hampshire Secretary of State. Bond claims for violations may be filed against ClearPath Credit and the surety for actual damages (not punitive). -ClearPath Credit does not guarantee improved credit scores, item removals, or financial outcomes. Results vary based on your report and creditor responses.

-Services may affect your credit temporarily; consult a financial advisor.

-You may contact the New Hampshire Banking Department (603-271-3561) or Consumer Protection Bureau for complaints.

This disclosure is provided in at least 10-point bold type, as required by RSA 359-D:6.

5. Contracts and Pricing

Every contract is in writing, dated, and signed by you. It includes:

-A conspicuous 10-point bold cancellation notice (see Section 6).

-Payment terms: Monthly billing via Stripe ($79–$199/plan; no upfront fees except post-performance). Total payments: [e.g., $79/month for Basic].

-Full service description, estimated timelines (e.g., audit in 48 hours), and no guarantees.

-A copy of the signed contract and all documents is provided immediately.

-Pricing aligns with industry standards (e.g., Credit Saint's $79–$139/month tiers). Plans: Basic ($79/mo), Growth ($129/mo), Elite ($199/mo). Add-ons: $29–$199. No refunds after performance; pro-rated for unused months on cancellation.

6. Cancellation and Refund Policy

-3-Day Federal Right (CROA): Cancel within 3 business days of signing for full refund (written notice to support@clearpathcredit.com).

-5-Day State Right (RSA 359-D:6): You may cancel at any time prior to midnight of the fifth business day after the transaction date. Send notice to [Address] with the following form:

-Post-5-Day: Cancel anytime with 7 days' written notice. No pro-rated refunds for partial months. 90-Day Money-Back: Full refund if no disputes filed.

7. Payments and Fees

-Billed monthly via credit card.

-Late fees: $25 after 10 days (max per RSA 358-A).

-No advance fees without bond (per RSA 359-D:3(I)). We charge only after Services performed.


8. Limitation of Liability

To the fullest extent permitted by law, ClearPath Credit's liability is limited to fees paid. We are not liable for indirect damages, score changes, or creditor actions. Services are provided "as is," without warranties. This mirrors limitations in contracts from CSOs like Lexington Law.


9. Surety Bond and Claims
ClearPath Credit maintains a $10,000 surety bond (5% of prior-year fees, min. $5,000/max. $25,000 per RSA 359-D:8), filed annually with the NH Secretary of State. Claims for violations (actual damages only) may be filed against us and the surety [Surety Name/Address]. Bond adjusted yearly by [Date].

10. Governing Law and Dispute Resolution

Governed by New Hampshire law (RSA Chapter 359-D and 358-A). Disputes resolved via arbitration in Concord, NH, under American Arbitration Association rules (no class actions). You may sue for violations in NH Superior Court. Attorney's fees awarded to prevailing party.

11. Changes to Terms

We may update Terms with 30 days' notice via email/website. Continued use constitutes acceptance.
